DUNBARTON BOARD OF SELECTMEN

MINUTES OF MEETING

THURSDAY, DECEMBER 22,  2005

TOWN OFFICES – 7:00 P.M.

 

The regularly scheduled weekly meeting of the Dunbarton Board of Selectmen was held at the above time, date and place with Chairman Charles (Chuck) Graybill  presiding.  It was noted that the meeting was called to order at 7:03 p.m.  The following were present:

The Selectmen reviewed correspondence and signed checks prior to the Public Meeting was called to order.

 

The Selectmen signed and approved the minutes of the previous Selectmen’s Meeting of  December 15, 2005 prior to the opening of the meeting. 

 

Mert Mann thanked Alison Vallieres for her Secretarial work and being here. 

 

GENERAL BUSINESS:

 

Proposed Temporary Sign Regulations:

 

Les Hammond proposed that the Selectmen pass a Temporary Sign Regulation similar to one the Town of Hampstead, New Hampshire has adopted.  (attached)

 

Charles (Chuck) Graybill stated he had no strong objections to the way it has been going for the past few years but would be willing to consider the proposed regulations.

 

After discussion, members of the Board of Selectmen agreed to start the process for the Temporary Sign Regulations. 

 

The suggestion was made to add item 8. which would read that the individual responsible for the enforcement of the code would be the Building Inspector. 

 

Les Hammond suggested that the regulations not take effect until after a two or three month period to get the public aware of the new regulations.

 

Janice VandeBogart will set up a Public Hearing for the second meeting in January 2006.

 

Stinson Road – Phase One:

 

1.        Janice VandeBogart gave the Board of Selectmen a copy of an e-mail from Richard Manburg, LaMontagne Builders requesting that the Town of Dunbarton accept Stinson Road – Phase One in order for them to be able to receive Certificates of Occupancy this winter.  (attached)

 

2.        The Board of Selectmen noted that the Road Agent and the Board of Selectmen had discussed plowing of Stinson Drive previously, and they had agreed not to plow it this season because there were no occupied homes on the road.

 

3.        After discussion, it was agreed that Kenneth Swayze, Building Department, will keep the Board of Selectmen advised and give them one month’s advance notice prior to the need for the issuance of a Certificate of Occupancy.  At that time, the Board of Selectmen will start the process and post a Public Hearing for acceptance of the road.

 

Jay Drive: 

 

1.        Gary Chicoine, Mike Brown,  Roland Voisine of Dig-Rite, Contractors for Jay Drive  and Don Mayo, Town Engineer, and Ken Swayze representing the Town of Dunbarton appeared before the Board of Selectmen to discuss the possible return of their Bond of $20,000 for the road.  Chicoine, Brown and Voisine stated they have done the shoulders as requested by Don Mayo and their bond money should be returned in full. 

 

2.        Gary Chicoine stated that they had to wait four weeks for the go-ahead from the Town with the shoulders.  This is the reason it was done after a snow storm.  Why did it take so long to give us the go-ahead? 

 

3.        Don Mayo, Town Engineer, has stated that the shoulder work has not been satisfactorily completed.   In addition, there are property bounds which need to be replaced.  (attached letter)

 

4.        Mike Brown stated that the bounds had been either removed or damaged after they had been set, and he did not feel it was their responsibility to replace them after the properties had been sold, etc.    

 

5.         Don Mayo, Town Engineer, has recommended that they complete the shoulders in the spring when the shoulders and adjacent grass areas can be satisfactorily graded. 

 

6.        The Board of Selectmen stated they would hold back $10,000 for the necessary shoulder work and property bounds. 

 

7.        Gary Chicoine, Mike Brown and Roland Voisine all stated that $10,000 was way too much money to be holding back for the work.  They stated they have done the work, and the bond should be returned to them.

 

8.        After discussion, the Selectmen agreed to offer to return $15,000 leaving $5,000 remaining until spring when the work could be completed.  The $5,000 would be returned in the spring. 

 

9.        Chicoine, Brown and Voisine all agreed that this was way too much money to be held back and will contact Town Counsel regarding the situation.   They did not accept the Selectmen’s offer that $5,000 would be held by the Town for the outstanding shoulder/bound work to be done in the spring. 

 

There was no resolution to the situation.

MOTION:

 

A motion was made by Mert Mann to adjourn the Dunbarton Board of Selectmen’s Meeting at 8:30 p.m.  Les Hammond seconded the motion.  The motion passed unanimously.
