MINUTES OF MEETING

Sept. 16, 2004

7:00 p.m.  Chuck opened the meeting and the Board signed checks. 

Other Business:

Ken updated the Board on the previous night’s Planning Board meeting, including an extension granted on a junkyard, a right of way discussion and the proposed golf course development.  There have been 20 building permits issued so far this year.

 

7:20 p.m.  Brett St. Clair, Nassika property (Kimball Pond conservation area) paperwork

Brett bought in the following paperwork, which was all signed by the Board and Les Hammond and notarized, where applicable, by Linda Peters:

  • Quitclaim deed to transfer the property from the corporation to the Town
  • Real estate transfer tax form – the Town isn’t liable for this tax
  • Affidavits for title insurance

 

Brett also updated the Board on the milfoil situation at Gorham Pond.  They have sent out to bid for the clean up of the pond.  Brett indicated that the State only has $60,000 in matching funds for next year.  Last year only one side was treated.  In order to do the most comprehensive form of treatment, the pelletized treatment, swimming and drinking from the lake would be prohibited for two weeks.  The State has estimated a cost to clean up the lake at about $20,000.  Brett noted that they found weed watchers for other ponds in Town.  Kimball Pond has no milfoil, at this point.  There have been no reports on the other ponds.

 

Chuck indicated that Mert reported that the Town Center Building Committee is meeting next Tuesday at 7 p.m. 

 

Chuck asked why the Conservation Commission wanted four alternates.  Brett indicated that the Commission sought out this many alternates to lighten the workload and that they all have valuable backgrounds. 

 

A discussion on the golf course took place.  Brett said the Commission’s view was generally positive, and they felt it was the best way to maintain character.  Chuck mentioned that a developer, Bob Pike, bought out Don Lane. 

 

Brett indicated that the Commission would like to restrict the use of Whipple Rd. to nonmotorized vehicles.

 

8:00 p.m. – Guy Doucet, Jason Davies, Ken Swayze, Brad Asbury, Wayne Nichols; re:   Jacqueline Dr. home occupation of Guy Doucet

 

Ken updated the Board on the status of Guy Doucet’s home business.  He has not applied for a home occupation permit and the neighbors are concerned about the logging and trucking in the subdivision. He indicated that the neighbors would like to see something done about this ongoing business.   Ken noted that he saw a trail of trucks leaving the Doucet property.  J.R. reminded Guy that the Board had asked him to apply and to meet with his neighbors, to try to come to some understanding.  Jason Davies, an abutter, said that Guy’s business is not an inconvenience and that he doesn’t have any complaints.  Brad Asbury said there is a lot of truck/equipment and he doesn’t feel that the ordinance is being followed.  J.R.  noted that if Guy drives his own truck to and from his home that is okay.  Brad feels that it is a business, and the vehicles are an eyesore.  Ken noted that a home occupation doesn’t allow for noise or odors and that the timing is within the rules.  He indicated that he has contacted Town Counsel for a legal interpretation.  J.R. advised Guy to fill out the home occupation permit today and

Guy agreed to this. 

 

Guy asked what he was not complying with.  Mert said the confusion should be cleared up after looking at the attorney’s letter and after Guy completes the application.

 

Ken asked Brad Asbury if he would be satisfied with prior notification on an occasional basis.  Brad indicated that he would be willing to talk at any point. 

 

Wayne Nichols, who appears to work for Guy, asked what was out of hand.  Brad responded that there is a logging business in a residential neighborhood and wants to know if it is allowed.  Wayne indicated that he has a log of the date and time of all trucks coming in and out and that it averages 3 times per week.  Brad mentioned that it was worse previously and reiterated that he would like to know what is allowed.  Ken mentioned that there is no more parking on the cul de sac and that the early morning and evening noise complaints have been resolved. 

 

8:15 p.m.  Jason Goyner and Ron Moyle, re:  camper under the New England Power Grid, adjacent to the Pioneer Sportsman Club.

 Ken updated the Board on the situation.  Mr. Moyle has been inhabiting his camper under the power lines, which is through State property.  Ken has told him this is not allowed, that he cannot get a building permit due to there being no road frontage.  Access and wetlands are other issues.  The State blocked him from crossing State property.  A discussion of health aspects took place.  Other concerns for the Town are welfare, zoning, safety and health.    Mr. Moyle has missed every appointment that he has had with Ken.  Jason Goyner is concerned about health aspects, particularly waste matter.  He has noticed an offensive odor, recently. 

 

Ron Moyle indicated that the Pioneer Sportsman Club is in negotiations with him, if he can get his property back, (which was taken by the Town for nonpayment of taxes), concerning a possible 99 year lease.  The Board and Ken informed Ron that it is unacceptable for him to live under the power lines on a long term basis.  Ken further explained that he must have class five road frontage (under State law) and that the right of way is governed by the National Grid.  He would have to petition for use, but would probably be wasting his time.  J.R. told him he has to look for a place to put his camper.  The Board gave him until 10/1 to remove himself and his camper from the property.  Ken indicated that the State has agreed to move its barricade to let him out. 

 

Ron indicated that he has nowhere to go and has only $300 to his name.  He anticipates some income coming from both legal issues and his disability, but is not sure when. 

 

J.R. asked Ron if he understands what he has to do and Ron said he understands the Board’s position.

 

8:50 p.m.  Mert updated the Board on last night’s Planning Board meeting.

 

8:50 p.m. J.R. asked for public comment.  There was none.

 

8:50 p.m.  Mert moved to go into nonpublic session to discuss a personnel issue, pursuant to RSA 91.A.  J.R. seconded the motion.  All Board members voted “aye”.  The motion passed.

 

9:30 p.m.  Mert moved to end non public session. J.R. seconded the motion.  All Board members voted “aye”.  The motion carried.  Mert moved to adjourn the meeting.  Chuck seconded the motion.  The motion carried.
