MINUTES OF MEETING

 

September 5, 2002

The Selectmen briefly discussed last night’s Planning Board work session and the new State building codes.

 

Resignation:  J. R. Swindlehurst made the motion to accept the resignation of Keith Margeneau from the Solid Waste and Recycling Committee effective this date, with regret.  Motion was seconded by Les Hammond, all were in favor.

 

John Swindlehurst:  John spoke briefly about the Neer property on Long Pond Road.  He stated that he wished to purchase part of this property and has an application before the Planning Board this month for a lot line adjustment and annexation to his lot.  He produced maps which showed the above.  He stated that he hoped this would clear up the question regarding the Right-Of-Way on this property. 

 

Jim Williamson:  Jim Williamson appeared before the board on behalf of Andy Michael.  Mr. Michael wanted to know why the town did not pave the area of town road which is used as part of his driveway when Holmes Road was recently paved.  The Road Agent, Jan VandeBogart, was present and explained that this section of the road is still an open road but didn’t need to be paved because it is not a traveled way by the public. It is used as part of Mr. Michael’s driveway.  He also stated that the town does not need to pave any road in town that it feels does not need to be paved.  He came in to consult with the Selectmen about this before the road was paved and the Selectmen agreed not to pave this area.  Mr. Williamson stated that Mr. Michael was very upset and wanted to know if this was a “slight” against him.  He was assured by all that this was not done to upset Mr. Michael in any way and was not a personal attack on him but was a mutual decision not use taxpayers money to pave a town road which is part of someone’s driveway. 

 

Mr. Williamson asked if it was true that the town had patched this area before.  The Road Agent confirmed that yes it had but stated that Mr. Michael had purchased the patch and the town put it down.

 

Mr. Williamson stated that he would like to see this part of the road paved.  He asked for the opinion of the board and the Road Agent.  Would the area be paved?  The Road Agent stated that he felt it should not be paved because of reasons stated above but would do as the Selectmen wanted.  J. R. Swindlehurst stated that because there is a dispute between neighbors Michael and Sowle regarding this and is now in the hands of the courts, he felt that the town should do nothing until the case is settled.   Chuck Graybill agreed and further stated that he agreed with the Road Agent that town funds should not be spent on paving this road.  He also stated that this section of the town road should have been discontinued.   Les Hammond stated that he would like to talk again about changing the entrance to Holmes Road, using the old State road across from John Mills’ home.  This would have to go to a vote at town meeting. 

 

Jim Williamson stated that he would be back to see the board after the law suit had been settled.

 

Resignation:  Les Hammond made the motion to accept the resignation of Pat Whittier from the Old Home Day Committee.  The motion was seconded by J. R. Swindlehust, all were in favor.

 

Road Agent, other business:  Chuck Graybill asked the Road Agent if he would submit to the Planning Board a letter outlining the size of hammer heads and culdesacs, showing diagrams, that he and the fire chief would like to be implemented in the sub-division regulations.  Jan stated he would do so by their next meeting, scheduled for 9/18/02.  Chuck also asked to have trees by Lurgio property on Gorham Pond Road cut because they are dead.  He asked about striping of the roads and was informed that they have been called and will be scheduling Dunbarton soon.

 

Tom Gleason:  Tom brought in the attached request.

1.      That the burned mobile home on Karen Meehan’s property be removed as soon as possible.

2.      That the failed septic system which services his mobile home be repaired as soon as possible.

 

J. R. Swindlehurst brought to the board’s attention that the burned mobile home is still in the name of Mike Leach and Valerie A. Clegg (J3-2-2M1).  It was noted by Mr. Gleason that Mrs. Meehan has a deal with the Leach/Clegg  but he realizes that they are still the legal owner.

 

Mr. Gleason stated that the septic system had already been evaluated by the Building Inspector/Health Officer and he produced a letter received from their department (see attached).  Mr. Gleason requested that a letter be sent to Karen Meehan and to Leach & Clegg with a copy to him requesting the removal of the burned mobile home.  He also requested a separate letter be mailed to Karen Meehan requesting that the failed septic system be repaired as soon as possible.

 

The Board agreed and will notify the Building Inspector in writing.

 

Town Clerk, Linda Peters:  Linda stated that Tom Gleason had requested copies of Rabies Certificates, Dog Licenses and all records pertaining to dogs owned by Karen Meehen.  She went on to say that she did not feel comfortable about releasing such records because the law is not specific as to weather these records are public or not  and she did not want the town to be open for a potential law suit.  She asked if the Selectmen would help her make the decision regarding this. 

 

Tom Gleason presented copies of RSAs regarding the licensing of dogs and copies of RSA 91-A regarding the right to know law (see attached).  He insisted that this information was public record and he had a right to have copies of them.  He stated he would call his attorney and did so in the presence of the Board.  He did not receive an answer from his attorney at this time.

 

Tom Gleason stated that he started the process of obtaining these records back in  March.  He felt that he has always had problems getting information from the town and wanted this put in minutes.

 

Chuck Graybill said that the records would not be released until the Selectmen had a chance to check with the town’s attorney.  As Chairman of the Board, Mr. Graybill would speak for the board.

 

John Turner, Assistant Building Inspector:   Mr. Turner was accompanied by Karen Toledo and Tom Zylak.  Ms. Toledo is currently building  a new home on Ordway Road and has two problems.

1.      Stairs:  This was a modular home and the company was called by Assistant Building Inspector, Harvey Provencher, informing them that Dunbarton requires a 7 ½ inch stair.  The stairs were not built to code.

2.      The Second Floor:  Not complete but Ms. Toledo agreed that she would not be occupying the second floor at this time.

 

Chuck Graybill stated that the town would issued a temporary CO with a time limit put on it for the completion of the upstairs and the correction of the stairs.  The completion date would be February 1, 2003.  All were in agreement.

 

John Turner was also informed about the two requests received this evening from Tom Gleason regarding the Meehan property:  Burned mobile home removal and the failed septic system.   A memo regarding these two issues will be issued from the Board of Selectmen to the building department.  In turn, the building department will issue certified letters to the appropriate parties advising a time table for the removal of the mobile home and the replacement of the septic system. 

 

Scott Harrington Property:  The building department should review this property to see if it is inhabitable.  John Turner agreed to follow up on this at their next meeting scheduled for Wednesday September 11th.  

 

The Board also indicated that the new state building codes would be in effective September 14, 2002.  If the Building Inspectors would like to see additions to the code, please let the Selectmen know because any additions would have to be accepted at town meeting.

 

 

Motion to adjourn was made by Chairman, Chuck Graybill, seconded by Les Hammond, all in favor.
