MINUTES OF MEETING

Planning Board Members: Planning Board Chairman, Jim Marcou and Co-Chairman, Ken Swayze, were in to discuss the upcoming agenda for the Planning Board meeting of October 16, 2002.
1. Old business: George Nicolaou came in at the October 2, 2002 workshop meeting and stated that he did not want to deed land to the town at the corner of Mansion Road and Route 13 as agreed. He did however, come in to the town office the day after and signed a quitclaim deed, deeding the land to the town. The planning board had asked for a warranty deed not a quitclaim deed. He also wanted to charge the town for the land. Mr. Nicolaou also stated to the planning board that the state was not interested in having land to fix this corner. No one on the board know about this. He also did not want to place granite markers but it was stated by J. R. Swindlehurst that the markers have already been placed. The board stated that they would not sign the mylar without the deed and marker placement.
2. Old business: Rick Martin, Tenney Hill subdivision: He was lacking the wetlands approval which must be presented to the board before they can sign the mylar. Mr. Swayze stated that he had talked to Mr. Martin and he had indicated that he was not going to apply for a wetlands permit. He was instead going to build a bridge. It was also stated that his driveway had already been cut in. He had agreed to buy culverts for the town and to this date had not purchased them. The trees have been cut, according to Chuck Graybill. Mr. Swayze stated that the deed which he was to deed to the town from the center of the road had not been prepared and the board would have to have that also. Everyone was in agreement that if Mr. Martin did build a bridge it would be under the jurisdiction of the building inspector.
3. Stark Lane, Michel Belanger, 22 lot subdivision (proposed): Don Mayo has plans to review. Jacques Belanger was working with the state and the town forest committee for the alterations to Stark Lane to improve site distance. Jacques was not encourage by the outcome of their meeting last Saturday. The board will discuss with the developer.
4. Keefe proposed subdivision: Talked about Mr. Keefe’s easement to Ray Road being turned over to the town and tie it to the open space to secure land for the town with no restrictions. The Planning Board will also ask for engineering fees from Mr. Keefe (in advance).
5. The board reported that at their October 2nd meeting they met with the New Hampshire Regional Planning Commission regarding updating Dunbarton’s master plan. They will meet with RKG Associates (the firm who prepared the last Master Plan) at their November meeting. They will be putting the job out to bid later.
John Trottier, Zoning Board Chairman, Building Inspector, Harvey Provencher, and planning board, Ken Swayze and Jim Marcou: Discussion ensued regarding set backs for wells. Many wells in the community have failed due to the drought and homeowners who cannot meet the set back of 75 ft. were advised to go before the zoning board for a variance before they could drill another well. Also they would have to have a certified plot plan to present to the board. The discussion was weather to give the building inspector the authority to allow landowners of failed wells or replacement wells on non-conforming lots permission to dig another well closer than the required 75 ft. A release form would have to be signed by the landowner which would release the town of any liability and an as-built would have to be presented to the building inspector after the well is dug. After much discussion it was decided that John Trottier would get back to the Building Inspector as soon as possible on how to proceed.
Jim Marcou, Subdivision road, Caleb’s Way: The Selectmen gave Jim Marcou a letter outlining items that needed to be done to Caleb’s way before it could be accepted by the town. (see attached). Jim stated that he had received a letter in March that stated he had four things to do in order to finish the road and have it accepted by the town. He then received a list from Don May, Town Engineer, of things that needed to be done, dated May 13, 2002. Now he has received this letter going over the same items. Chuck Graybill stated that the ditch along Mansion Road, approximately 100 ft, would have to be re-graded. Also, delineation markers be placed near the culvert. This was an alternative to have Mr. Marcou replace the culvert. Mr. Marcou agreed to make the ditch line deeper and also agreed to replace the culvert if it still leaked in the spring. He also agreed to cut the trees. Mr. Marcou also agreed to pay for the final coat of asphalt. He will pay Pike Industries plus 10% for the final coat. The Selectmen stated that the final coat would not be put down until all the houses are built so Mr. Marcou would have to renew his letter of credit annually.
Mr. Marcou also stated that the town does not have to plow this road this winter, he would probably be blocking it off as he didn’t want cars going in and out anyway.
Motion to adjourn was made by J. R. Swindlehurst and seconded by Les Hammond, all in favor.
