Dunbarton Ethics Committee

Thursday, 16 December 2004

Minutes of meetings are subject to final approval at the next scheduled meeting

Attending:  Nick Holmes, Scott Ives, Brigitte Cook and Jackie Kennedy

Public Present:  Patrick Bowne and Lori Davis

Nick Holmes called the meeting to order at 7:30 p.m.

The town administrator has notified the committee that all year-end committee reports are due by January 15, 2005 for the Annual Town Report.  Brett will work on this report.

Before us tonight is a request from the selectmen for a written advisory opinion.

Recusal: The committee determined that none of the members present had a relationship that required recusal.

Nick went through the Ethic Code as it pertained to this opinion.  Part 1 A of the Code, Paragraph 2 states; ‘As a town official, board member or employee, you shall not participate in any matter in which you, or a member of your family, have a personal interest which may directly or indirectly affect or influence the performance of your duties.’

We reviewed the Ethic Code as it pertained to this opinion. After a lengthy discussion of what constituted ‘conflict of interest’ in this particular case, the committee all agreed that there is a danger of the appearance of a conflict of interest as it pertains to Section 1A.  A written opinion will be sent to the selectmen as soon as possible.

The next scheduled meeting is January 20, 2005.

Motion by Nick to adjourn second by Scott.  Meeting adjourned at 8:30 p.m.

Respectfully submitted for the committee:

Jacqueline A. Kennedy
